Welcome to Purple Comet LLC (“Purple Comet,” “we,” “us,” or “our”), a California limited liability company. These Terms of Service (“Terms”) govern your access to and use of our corporate website (purplecometllc.com), software applications, tools, and digital ventures (collectively, the “Services”).
By accessing or using any of our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.
1. Scope & Product-Specific Terms
Purple Comet operates a diverse portfolio of independent digital products, including software utilities, creative studios, desktop software, and experimental tools.
- When an individual product or service maintains its own dedicated Terms of Service or End User License Agreement (EULA), that product-specific agreement governs your use of that product.
- Where an individual product, tool, or experiment does not display a separate terms document, these baseline Purple Comet LLC Terms of Service govern your use.
- In the event of an irreconcilable conflict between these general terms and product-specific terms, the product-specific terms control for that particular product.
2. Acceptable Use Policy
You agree to use our Services only for lawful purposes in compliance with all applicable local, national, and international laws and regulations. You agree that you will not:
- Distribute, generate, or link to malware, spyware, phishing scams, trojans, ransomware, or credential-harvesting pages.
- Attempt to probe, scan, or test the vulnerability of any Purple Comet system or network, or breach security or authentication measures.
- Launch automated scraping, denial of service (DoS) attacks, or excessive queries intended to degrade service reliability for other users.
- Transmit or process content that infringes any patent, trademark, trade secret, copyright, right of publicity, or other proprietary rights of any party.
- Use any of our AI or image processing utilities to generate or manipulate non-consensual sexual imagery, child exploitation material (CSAM), or defamatory impersonations.
Any account, short link, or dynamic redirect detected engaging in unlawful activities or phishing will be immediately terminated without prior notice or refund.
3. Intellectual Property & Your Content
Your Content: You retain all ownership, copyright, and commercial rights to the original content, files, logos, and images you upload or generate using our Services. You grant Purple Comet a limited, non-exclusive license solely to process, host, and transmit your content as necessary to provide the Services to you.
Our Platform: The code, design, logos, trademarks, and user interfaces of Purple Comet LLC and its products are the exclusive intellectual property of Purple Comet LLC and its licensors.
4. AI Services & No Biometric Identifiers
Certain Purple Comet products utilize artificial intelligence and machine learning models (such as image upscalers, background segmenters, and local language models). AI outputs are generated through statistical algorithms and may occasionally produce inaccurate, unexpected, or imperfect results.
5. Digital Millennium Copyright Act (DMCA) Notice
Purple Comet LLC respects intellectual property rights and expects its users to do the same. If you believe your copyrighted work has been copied or linked to in a manner that constitutes infringement, please submit a written DMCA notice to our designated agent containing:
- Physical or electronic signature of the copyright owner or authorized representative.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material to be removed, including specific URLs or dynamic link slugs.
- Your contact information (address, phone number, and email address).
- A statement that you have a good-faith belief that use of the material is unauthorized.
- A statement, under penalty of perjury, that the information in your notice is accurate.

6. Subscriptions, Auto-Renewal & Billing
Where any Purple Comet product offers paid subscriptions or credit bundles:
- Recurring Billing: Subscriptions automatically renew at the disclosed monthly or annual frequency unless canceled before the next renewal date.
- Self-Service Online Cancellation: You may cancel your subscription at any time directly through your account dashboard or via the Stripe customer billing portal. Cancellation takes effect at the conclusion of your current billing period.
- Refunds: Payments are non-refundable except where required by law or explicitly stated in a product’s specific refund policy.
7. Disclaimer of Warranties
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR FREEDOM FROM COMPUTER VIRUSES OR DEFECTS. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE. ALWAYS TEST PHYSICAL PRINT PROOFS OF QR CODES PRIOR TO LARGE-SCALE COMMERCIAL PRINTING RUNS.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL PURPLE COMET LLC, ITS DIRECTORS, MEMBERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, GOODWILL, REPRINT COSTS, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OR INABILITY TO USE THE SERVICES.
IN NO EVENT SHALL OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100.00 USD) OR THE AMOUNT PAID BY YOU TO PURPLE COMET LLC IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
9. Mandatory Binding Arbitration & Class Action Waiver
PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT AND HAVE A JURY HEAR YOUR CLAIMS.
You and Purple Comet LLC agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be settled by binding, individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules, rather than in court, except that you may assert claims in small claims court if your claims qualify.
CLASS ACTION WAIVER: YOU AND PURPLE COMET LLC AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
10. Governing Law & Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law principles. Any dispute not subject to arbitration shall be brought exclusively in the state or federal courts located in California, and you consent to the personal jurisdiction of such courts.
